Terms of Service
Please read these terms carefully before using The Flying Decksman. By using the Platform you agree to be bound by them.

Acceptance of Terms
By accessing or using The Flying Decksman platform ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all visitors, registered listeners, and artists using the Platform.
What the Platform Offers
The Flying Decksman is an independent music platform that allows: • Free streaming of mixes curated and uploaded by DJ Tela and featured artists. • Purchase of individual tracks directly from independent artists. • Artist accounts that allow creators to upload, manage, and sell their music. Content availability may change at any time without notice.
User Accounts
To access protected features (purchases, library, playback history), you must create an account. You are responsible for maintaining the confidentiality of your login credentials. You must provide accurate information during registration and keep it up to date. One person may not maintain more than one active listener account. We reserve the right to suspend or terminate accounts that violate these terms.
Track Purchases & Licensing
When you purchase a track on the Platform, you acquire a personal, non-exclusive, non-transferable licence to listen to that track for private, non-commercial use. This licence does not give you ownership of the underlying copyright. You may not: • Re-sell, redistribute, or sublicence the purchased track. • Use purchased tracks in commercial productions, broadcasts, or DJ sets without separate written permission from the artist. • Upload or share purchased files on any public platform. Purchased tracks are linked to your account and accessible via your Library.
Free Mixes
Mixes streamed for free on the Platform are provided for personal listening only. They may not be downloaded, redistributed, monetised, or used in any broadcast or public performance without prior written consent from the uploader.
Artist Terms
Artists who upload content to the Platform agree that: • They own or have secured all necessary rights to the content they upload. • By uploading, they grant The Flying Decksman a non-exclusive licence to host, stream, and sell that content on the Platform. • Revenue from track sales is split 80% to the artist and 20% to the Platform as a service fee (see Revenue Split page for full details). • The Platform may remove content that violates these terms or applicable law without prior notice. • Artist accounts require admin approval before content becomes publicly visible.
Payments
All payments are processed securely through Paystack. By making a purchase, you agree to Paystack's terms and privacy policy. The Platform does not store card details. Prices are displayed in Kenyan Shillings (KES). In the event of a failed payment, no charge is made to your account. The Platform is not liable for any bank or payment-processor fees charged on your end.
Refund Policy
All track purchases are final and non-refundable. Because digital content is delivered immediately upon purchase, we are unable to accept returns. If you experience a technical issue preventing access to purchased content, contact us and we will investigate within 5 business days.
Intellectual Property
All original content on the Platform — including the platform name, logo, design, and DJ Tela's mixes — is the intellectual property of The Flying Decksman or the respective rights holder. You may not reproduce, copy, or exploit any Platform content without express written permission.
Prohibited Conduct
You agree not to: • Attempt to reverse-engineer, scrape, or extract audio streams from the Platform. • Use automated bots or scripts to access Platform content. • Circumvent any access controls, DRM, or authentication mechanisms. • Post, upload, or distribute content that is unlawful, defamatory, or infringes third-party rights. • Impersonate another user, artist, or Platform employee.
Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant uninterrupted, error-free, or secure access to the Platform. We are not responsible for the accuracy, completeness, or legality of content uploaded by artists.
Limitation of Liability
To the fullest extent permitted by law, The Flying Decksman shall not be liable for any indirect, incidental, or consequential damages arising out of your use of, or inability to use, the Platform — including loss of data or revenue. Our total aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
Changes to These Terms
We may update these terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised terms. The "Last Updated" date at the top of this page will reflect when changes were last made.
